These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Smithville.
REQUEST FOR RELEASE OF FUNDS
On or about 5/16/23, the City of Smithville (City) will submit a request to the Texas General Land Office for the release of Community Development Block Grant Mitigation (CDBG-MIT) funds appropriated under the Supplemental Appropriations for Disaster Relief Requirements Act, 2018 (Pub. L. 115-123), as amended, to undertake a project known as Flood and Drainage Improvements under GLO Contract #22-085-020-D256 to mitigate the risk of flooding in the project areas.
Description of the Proposed Project:
Flood and Drainage Facilities: Subrecipient shall construct two regional detention ponds, install new storm sewer systems to connect to the regional ponds, and upgrade/extend the City’s existing storm sewer with associated pavement repair, and complete all associated appurtenances.
Included in this Environmental Assessment are the following project activities only:
Part 1: The scope of work includes upgrading the existing storm sewer system along NE/ NW 2nd Street from Gresham Street to Ramona Street, as well as the adjoining streets in this area. The scope of work also includes reconstructing the existing streets to properly drain to the improved system. As illustrated on the attached map exhibit, this part will tie into, and be a continuation of, two projects that are currently planned and funded, and expected to go to construction in the summer/ fall of 2021. These improvements will help mitigate the risk of stormwater flooding existing businesses, residences, and streets in the downtown area.
Part 3: The scope of work includes extending the existing storm sewer system from Short Street and NE 5th Street east to Garwood Street. From Garwood Street and NE 5th Street, the storm sewer would then be extended north along Garwood Street to NE 6th Street and then east to Bishop Street. From Garwood Street and NE 5th Street, the storm sewer would also be extended south along Garwood Street to NE 4th Street and then east to Turney Street. Finally, this part would include enlarging the existing storm sewer line along Byrne Street from NE 5th Street to NE 6th Street. These improvements will help mitigate the risk of stormwater flooding of the existing residential neighborhoods within and near this area.

Part 2 and Part 4 locations under this contract will be cleared in a separate Environmental Assessment. The drainage for these SE locations will flow into Willow Creek, and the NW locations will flow into Gazley Creek; therefore, they are not connected. The pond locations are yet to be finalized and will require archeological surveys. |

FINDING OF NO SIGNIFICANT IMPACT
The City has determined that the project will have no significant impact on the human environment; therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR). The ERR will be made available to the public for review either electronically or by U.S. mail. Please submit your request by U.S. mail to the City at the address above, or by email to the City Manager.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City. All comments received by 5/15/23 will be considered by the City prior to authorizing submission of a request for release of funds. Comments must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the City at citymanager@ci.smithville.tx.us. Comments should specify which Notice they are addressing. Potential objectors should contact the City via email to verify the actual last day of the objection period.
ENVIRONMENTAL CERTIFICATION
The City of Smithville certifies to the Texas General Land Office that Robert Tamble, in his capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Texas General Land Office’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
The Texas General Land Office will accept objections to its release of funds and the City’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request, (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City; (b) the City has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Texas General Land Office; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to PO Box 12873 Austin, Texas 78711-2873, or ATTN: Environmental Review Specialist.
